    That's great in theory, but miscarriages happen all the time.

    Look at how many people appeal their convictions and get them turned over.

    I'm sorry, but it's an imperfect system.

    Obviously the system of convicting people would have to be flawless before such measures could be brought in. But if they ever did then why not.... maybe not death but some other harsh form of punishment.

    We can always wait til technology allows us to predict such crimes. Minority Report style!! :D

    Doesnt change my views about the people who were proven guilty or admitted their guilt though.

    Anyone know any examples of a recent apparent "water tight" conviction that was disproven?

    In texas Leonel Torres Herrera, was sentenced to death for the murder of 2 police officers.

    New evidence eventually proved, Herrera's brother was the murderer, however under Texas law any new evidence must appear within 30 days of conviction so the new evidence was deemed irrelevant.

    The U.S. supreme court upheld the Texas ruling, as the new evidence was not a constitutional claim for which judicial relief could be granted.

    They executed him shortly after the supreme court ruling.

    I could spend all day providing you with further examples of the miscarriages of justice, but i can't be bothered.

    the genius that is George W. Bush signed the death warrant despite mass pleas for either clemency to be granted, or to at least commute his sentence to life.

    How about the numerous 'i killed my babies' cases from recent times... 3 babies died and the jury was told " it's a 1 in 3,000,000,000,000 chance or something" - and now how many convictions are being over turned?

    if she'd have been convicted of killing 3 babies - she's would of been at the top of any capital punishment list!

    No conviction by jury can be 100% sure...

    Thats a really interesting point!
    There are a lot of our country's laws that i really just dont get, such as the double jeopardy law. Why is it still in place? :confused:

    i didnt realise! i knew people had been campaigning for years to get rid of it, but i didnt realise they had overturned it. But they are only doing it in extreme cases such as murder - why?
    I find it a bit strange that they never got rid of it before now, but i guess advances in forensic science and all that means that more people can be proved guilty if they were re-trialed (sp?).

    To be fair before reading through this thread and looking at some of the valid points people were making, i would of said yes 2 capital punishment.

    SOME of the people who are sick enough in the head to kill some one might not really be bothered about the death pentalty, but obviouslly im not talking about all of them, just some! But the ones who are shouldnt get the satisfaction of the easy way out imo now. They should be made to pay for what they have done, and have 2 suffer, because the person they have killed or raped etc had to suffer. they could be given a punishment equal to the extent of the crime they have comitted, however who is to say what is a satisfactory punishment for murder for example. I wouldnt want to go as far as suggesting torture, but if something happened to a member of my family or something (god forbid!) I would want the person who did it to really suffer n feel some pain!An in short regret that they ever did it, hopefully making them not want to do something like that again.

    I really think the justice system is far 2 soft these days, its not detering any1 from commiting crime, so obviously its not working! MR Blair I hope ur reading lol! :angry:

    No, we are supoosed to be "civilised" that inlcudes not killing ppl whatever they have done.

    How can ppl ask this question??

    I admit if someone close was murdered id change my view in a instant but the victim is not the judge in this life.

    I agree that there have been plenty of wrong convictions for all sorts of crimes, so if even a small percentage of them were for murder, then we'd have a number of innocent people having the death penalty as their fate.

    Question is......what else can we do that is a reasonable punishment?

    Locking people up for life just means that the rest of us hard working, law abiding citizens pay for the criminal for the rest of his life.
    There are probably plenty of people in prison, serving long sentences that have never had it so good.

    I know of a local guy that was murdered by his (estranged) wife. She pre-planned it, phoned him with a story to get him to her house, started an argument with it and then stabbed him 37 times. Their daughter, aged about ten was there and she tried to stop it by throwing something through the window to try and distract her mam. The daughter even phoned the police while it was happening. About 18 of the stab wounds were i his groin area.
    The wife admitted the crime, the daughter was a witness.
    Here's the crunch.....it was the wife that had been shagging about !!!!

    I can't remember what her sentence was, but it was something like ten years.......diminished responsibilities or some crap!!

    Is that really enough for what she did??

    I'm not saying that we should "kill", but I am saying that we must have some better ways of dealing with these people.
    How about some really shitty prisons on little remote islands, where prisoners get treated like crap?

    It makes my blood boil when you hear all this bollox on telly about human rights for these people......they didn't think about the human rights of the people they killed did they?? F*CKERS!!

    fuck's sake, threads like this always piss me off. Our justice system is, or at least surely should be, intended to protect the innocent, not wreak retribution on the perpetrtor. Force as a deterrent clearly does not work ( usa, Russia ) unless taken to a brutal extent, when the means does not justify the end ( Sharia countries ).

    Just because somecrimes make you feel hate towards the perp, doesn't mean that we should allow those animalistic instincts to rule our heads - otherwise, why bother with justice at all, why not just leave criminals to be lynched.

    As a very wise man once said, an eye for an eye and everyone goes blind.
